A panel of Fourth Circuit judges has ruled that the National Marine Fisheries Service must rewrite a Biological Opinion it released in November 2008 to protect endangered salmon from diazinon, chlorpyrifos, and malathion. They found the BiOp was arbitrary and capricious and that their recommendations to protect salmon from the pesticides were based "on a selection of data, tests and standards that did not always appear logical, obvious or even rational."

Groups representing the oil and food industries have petitioned the Supreme Court to reverse a lower court's ruling siding with the EPA's decision to allow the use of E15 in vehicles model year 2001 and later. The Renewable Fuels Association’s Bob Dinneen said, "We now know why gas prices keep going up and up -- to fund unnecessary Big Oil lawsuits to protect their monopoly on the fuel market."

The United States Cattlemen's Association has filed comments with Fish and Wildlife regarding its plan to reintroduce the Black Footed Ferret in 12 Western states.The ferret reintroduction plan involves preservation and maintenance of prairie dog populations, which are the ferret's principle prey and incorporates the use of insecticides and research of sylvatic vaccines.
